The Essential 10-Point Title Check
30-Year Search Report
A "Search Report" from the Sub-Registrar's office traces the chain of ownership for the last 30 years to ensure there are NO hidden encumbrances or mortgages.
Matrix (Form 1 & XIV)
This document from the Taluka's Mamlatdar office is the Bible for Goan land. It identifies the owner, the survey number, and the exact land-use category (Agricultural, Orchard, or Settlement).
Portuguese 'Escritura' Records
Older Goan properties may have their roots in Portuguese "Escrituras". Verifying these archives at the Civil Registrar's office is mandatory for heritage homes and ancestral plots.
Ancestral Property Partition
Since Goa follows the Portuguese Civil Code, inheritance laws are unique. Ensure all co-owners and legal heirs have signed a 'Partition Deed' or 'Release Deed'.
Nil Encumbrance Certificate
This certificate from the Sub-Registrar's office confirms that the property is not mortgaged to any bank or financial institution.
Sanad of Conversion (NA)
If you are buying a developed villa, ensure the land has a valid "Sanad" representing its legal conversion from Agricultural to Non-Agricultural (NA) use.
TCP & Panchayat Approvals
Verify that the current building on the land matches the technical clearances issued by the TCP and the final license from the Village Panchayat.
RERA Registration Check
For any new project, check the RERA Goa website to ensure the project is registered and the approved area matches the sale plan.
Public Notice in Newspapers
Always issue a Public Notice in one English and one Marathi local newspaper, inviting claims against the property within 7 days before the final Sale Deed.
Possession Certificate
Ensure the physical possession of the property matches the dimensions and survey numbers mentioned in the Title Deed.
